A BILL FOR AN ACT TO PROVIDE FOR THE ESTABLISHMENT OF THE NIGERIA ROAD INFRASTRUCTURE INTERVENTION AND RELATED MATTERS: 2019

TO BE ENACTED BY THE NATIONAL ASSEMBLY OF THE FEDERAL REPUBLIC OF NIGERIA AS FOLLOWS
1. As from the commencement of this Bill, it shall be lawful a s legitimate for the management, maintenance, rehabilitation and supervision of federal road to be concessioned for definite period of time to willing and competent engineering firms and other interested firms of repute with the financial where with all to undertake such projects as might be specified in appropriate enabling instruments.
2. It shall be lawful and legitimate for the management, maintenance, rehabilitation of federal roads to need concessioned to willing and competent engineering firms or any other repute with expertise in run road construction or project financing, to run for definite period as might be specified I'm appropriate instruments.
3. Every stretch of road falling into a concession lot shall be filled with concrete and reinforced iron rods that is not less than 18 inches thick.
4. Whenever any road is concessioned to any firm as stipulated in section 2 of this law, it shall be lawful for such firm to charge a toll and for that purpose may erect a toll gate or any other facility to enhance its collection of tolls.
5. The life tenure of every concessioned lot and the toll to be collected shall be determined by the total cost of executing the road project plus a 25 percentage interest on the capital.
6. The tolling rate payable by motorist shall be graded according to the weight and use of such vehicle at toll gate.
7. That at the end of the life span of any concessioned lot, the maintenance, rehabilitation management or supervision of the lot shall be taken over directly by the federal government or a state government, as approved by the federal government.
8. (1) that a certificate of compliance shall be issued to the winner of a concessioned lot at the completion of the road project by the appropriate department of the federal government, signed by the federal engineer superintending the project.
(2) that the certificate of compliance to be issued will be signed by the federal engineer superintending the project and shall be liable for any defect, irregularity or sloppiness in respect of the job so certified by him.
9. The process of bidding and award of concession lots shall be governed by extant rules and regulations of the federal government on award of contract.
10. There shall be weight regulations or compliance with such existing regulations for heavy duty vehicles plying the roads with goods.
11. It shall be the duty of the concessionaire to provide die an automated weight measurement equipment at the toll gate.
12. A concessioned lot at minimum shall not be less than 100 kilometers and at the maximum 150 kilometers, provided that no one individual firm or company shall be qualified for the award of more than one slot in the federation.
13. (a) It shall be an offence for any public officer charged with the duty of concessioning a road as stipulated in section 2 of this law for certifying the quality of such road to collude with the concessionaire in any way.
(b) Any such officer found to have colluded with a concessionaire shall be sentenced to a 5 year imprisonment without option of fine if guilty.
(c) the offence shall only be entertained by the federal high court.
14. This Bill may be cited as the road infrastructure intervention Bill.
EXPLANATORY MEMORANDUM
This Bill seeks to give legal backing to the federal government to go into Public Private Partnership (PPP) on the management, maintenance, rehabilitation and supervision of federal roads.
This Bill has passed first reading.
